OpenTable, Inc. and its subsidiaries (collectively, “we,” “our” or “us“) provide services in many different countries. As detailed in our Privacy Policy (the “Policy“), OpenTable acts as a data controller of certain personal information about users of OpenTable’s websites, applications, and other online services (individually referred to as “you“) and as a data processor of other personal information. When we act as a data controller of your personal information, the particular OpenTable entity that is the data controller depends on where you reside.

Each of the above entities is a subsidiary of OpenTable, Inc., a Delaware corporation, and any and all information concerning you that such subsidiary collects will be used jointly with OpenTable, Inc., for the purposes described in the Policy or disclosed to you on our Sites or otherwise in connection with our services. The above data controller is responsible for administration of such personal information subject to such joint use by OpenTable, Inc. (for example, accepting and responding to requests for disclosure and complaints).

Illegal Content and Content Moderation

If you suspect content on our site may be illegal, please send an email to eunotifications@opentable.com identifying the URL of the content, and including an explanation why you consider the content to be illegal and a statement confirming your bona fide belief that the information and allegations contained in your email are accurate and complete.

User submitted content such as reviews may be subject to automated or manual checks against rules further set out in our Terms of Use and may not be displayed or removed based on such prior checks or pursuant to a notice as set out in the previous paragraph.

If our decision to remove content can be appealed pursuant to article 20 of Regulation (EU) 2022/2065, we will provide a statement of reasons for our decision and information on how to lodge a complaint against the decision. Any complaints will be reviewed manually by our content moderation team against our content guidelines and the outcome of the review will be notified to the complainant.

If a recipient of the service is frequently found to provide manifestly illegal content or someone is frequently submitting notices or complaints that are manifestly unfounded as envisaged in article 23 DSA, then we will review the matter in accordance with article 23(3) DSA and, if the repeat offense is confirmed, we will issue a warning to the person in question, respectively suspend them after a prior warning. At this time we do not envisage such cases happening and will give examples of the facts and circumstances that we take into account when assessing whether certain behavior constitutes misuse and the duration of the suspension if and once we see such cases.

In accordance with OpenTable’s obligations under the EU’s Digital Services Act, we estimate that the average monthly recipients* of the OpenTable service in the European Union in the last six months, is well under 45 million.

This is only an estimate and is based on the data available to OpenTable at this time, and the limited guidance in the Digital Services Act (“DSA”). This estimate is required to be published under the DSA and should not be used for any other purposes. The methodologies used to estimate average monthly recipients as defined in the DSA require significant judgment and design inputs, are subject to data and other limitations, and inherently are subject to statistical variances and uncertainties. This estimate may be revised upwards or downwards as OpenTable refines its approach and in response to the publication of methodology by the European Commission.

* “recipient of service” is defined under the DSA to mean “any natural or legal person who uses an intermediary service, in particular for the purposes of seeking information and making it accessible”. This requires counting users to whom information was displayed by the OpenTable service, even if that user did not make a transaction.

Recommender Systems

We use recommender systems on our sites to help you discover content we think you will like, by weighing factors such as what you tell us in the search form, the popularity of various restaurants, and sometimes our expected revenue. Each factor can be more (or less) important in different cases, depending on what we think is most likely to produce content that is relevant for you.

Search Results: Our search results and rankings are one such recommender system on our site. Diner-initiated searches consider various factors in ranking restaurants, including: (a) what diners tell us in the search: date, time, party size, location, and any keywords; (b) any information we have gathered based on diners interactions with our platforms: past bookings, profile views, impressions from search etc.; (c) restaurant performance data: availability, bookings, reviews, profile views, booking patterns; (d) restaurant content: content of reviews, menus, descriptions, cuisines, location; and (e) how much we are paid by the restaurant.

Discovery Carousels: You may also see discovery carousels on our site which suggest restaurants and/or experiences that we think you may enjoy. In addition to the factors listed above, our discovery carousels consider restaurants that you have viewed, booked, or reviewed and may feature restaurants based on their similarity to restaurants you have visited in the past. Similarity may be based on diner reviews or menus.
